Terms & Conditions

Definitions:

Products: means the goods offered for sale and described on the Website.

Website: means the web domain divincenzoboutique.com and all subdomains connected to it. Any links within the pages of the Website that redirect to external websites not belonging to divincenzoboutique.com, for which the Seller is not responsible, are excluded.

Order / Contract: means the Purchase Order by which the Customer authorizes the Seller to deliver the ordered goods at the pre-established selling price.

Order Confirmation: means the EMAIL by which the seller confirms the Purchase Order placed by the Customer through the Website.

Consumer / Customer: these terms refer to any natural person who makes purchases for purposes unrelated to any entrepreneurial, commercial, artisan, or professional activity carried out.

Seller: "DiVincenzo", "we" and "the Seller" refer to the company Divincenzo Srl, with registered office in SANT’ANASTASIA (NA), VIA ROMANI, 94, VAT number 05887541216.

You: means You, our Customer.

These Conditions of Sale indicate the terms and conditions that will apply to the purchase of Products through the Website. Please read the Conditions of Sale carefully before placing an Order. By placing an Order through the Website and confirming that you have read and accepted the Conditions of Sale, you declare that you unconditionally accept the terms and conditions specified below.

To make purchases through the Website, the Consumer must be of legal age (18 years) and have the capacity to act, which the Consumer declares to possess.

The purchase of Products on the Website is exclusively reserved for consumer customers. The term "Consumer" means any natural person who makes purchases for purposes unrelated to any entrepreneurial, commercial, artisan, or professional activity carried out.

Individuals who are not Consumers are invited not to place purchase orders. If one or more sales are made to a party not qualifying as a Consumer, these Conditions will apply, but, notwithstanding the provisions thereof:

a) the Professional will not be granted the right of withdrawal;

b) the Professional will not be able to benefit from the Product warranty;

c) the Professional will not be granted any other protections provided herein in favor of the Consumer, which reflect or comply with mandatory legal provisions;

d) the sales contract concluded between the Seller and the Professional will be governed by Italian law, excluding the 1980 Vienna Convention.


In these Conditions of Sale, "DiVincenzo," "we," and "the Seller" refer to the company Divincenzo Srl, with registered office in SANT’ANASTASIA (NA), VIA COSTANZO ROMANI, 94, VAT number 05887541216, and "You" refers to You, our Customer.

Capitalized terms used in these Conditions of Sale shall be understood according to the meaning established below in the "Definitions" section of this document.


These Conditions of Sale, together with your Order Confirmation, constitute the contract for the supply of Products between Us and You. No other conditions or terms shall apply. The Contract cannot be amended, except for those we may agree upon in writing or via email.

A copy of these Conditions of Sale may be stored electronically or printed by all users of our Website.

 

IDENTITY AND CONTACT DETAILS

The company Divincenzo Srl, with registered office in SANT’ANASTASIA (NA), VIA COSTANZO ROMANI, 94, VAT number 05887541216 info@divincenzoboutique.com.

Any communication from the Consumer connected and/or related to the purchase of Products - including any reports, complaints, requests concerning the purchase and/or delivery of Products, the exercise of the right of withdrawal, etc. - must be sent to the Seller at the contact details and according to the methods indicated on the Website and to the email address customerservice@divincenzoboutique.com.

 

MAIN FEATURES OF THE GOODS

The characteristics of the products sold on the Website are described within it. The Products are sold according to the Conditions of Sale published on the website at the time the Consumer Customer submits the Order, excluding all other conditions or terms.

The Seller undertakes to make every reasonable effort to ensure that the prices and information relating to the Products for sale on the Website are updated and correct. However, it is not guaranteed or assured that every product will be available for purchase through the Order.

The Seller reserves the right to make changes to the information regarding the Products displayed on the Website concerning the description, availability, or prices of any Product for which you have received an Order Confirmation, at any time and without prior notice.

Changes to these Conditions of Sale will apply exclusively to sales made from that date.

SELECTION AND PURCHASE PROCEDURE

Products are offered to the public on the Website. The Customer selects the product and adds it to the virtual cart by clicking the "add to cart" button to make a purchase. Once the virtual cart is open, the Customer will select "go to checkout." The Consumer will be invited to register on the Website, providing the requested data, or to log in if the Consumer is already registered, or to provide their data to complete the order and allow the contract to be finalized. The Consumer will also be asked to choose the shipping method and payment method from those available. After placing the Order using the methods described above, the Consumer will receive an Order acknowledgment Email from the Seller, sent to the email address provided by the Consumer to the Seller at the time of registration on the Website or when submitting the Order if the Consumer is not registered on the Website. This email will contain a summary of the order placed and a description of the characteristics of the ordered Product. If payment is made by credit card, the purchase amount will only be debited at the time of the subsequent Order Confirmation from the Seller to the Consumer. The Consumer will be notified, via Email sent by the Seller, of the availability status of the Product subject to Preorder. If an order submitted by the Consumer to the Seller contains both an available Product and a Preorder Product, the Consumer acknowledges and expressly accepts that the related delivery will be carried out by the Seller only when the Preorder Product becomes available, as communicated via Email by the Seller to the Consumer. If, during the Product selection process on the Website, the Consumer finds that the price of one or more of the Products they intend to select for subsequent purchase is clearly lower than the normally applied price, net of any discounts and/or promotions then in force, due to an obvious technical problem occurring on the Website, they are requested not to complete their purchase Order and to report the aforementioned technical error to the Seller by sending an Email to info@divincenzoboutique.com

 

STATUTORY WARRANTY OF CONFORMITY

The Seller guarantees the Customer that the Products will be free from design and material defects, and will conform to the descriptions published on the Website, for a period of 2 years from the date of delivery to the Consumer, in accordance with and for the purposes of European Directive 44/99/EC and Italian Legislative Decree no. 206/2005 "Consumer Code." The application of any warranty is excluded in case of use or washing of the Product not in conformity with its proper use and the instructions/warnings provided by the Seller and/or the Owner, or indicated in the illustrative documentation, tags, or labels. The Customer is obliged to report any defects and non-conformities no later than 2 (two) months from discovery, under penalty of forfeiture of this warranty, by sending an email to customerservice@divincenzoboutique.com.

 

LIABILITY FOR DEFECTIVE PRODUCTS

Regarding any damages caused by defects in the Products, the provisions of European Directive 85/374/EEC and the Consumer Code shall apply. The Seller, in its capacity as distributor of the Products through the Website, is released from any and all liability, without exception, by indicating, upon request of the damaged Consumer, the identity and domicile of the relevant manufacturer.

INTELLECTUAL PROPERTY

The Consumer declares to be aware that all trademarks, names, as well as any distinctive sign, denomination, image, photograph, written or graphic text used on the Website or related to the Products are and remain the exclusive property of and/or its assignees, without the Consumer acquiring any right over them by accessing the Website and/or purchasing the Products. The contents of the Website may not be reproduced, either in whole or in part, transferred by electronic or conventional means, modified, or used for any purpose without the prior written consent of the Seller.

 

APPLICABLE LAW AND JURISDICTION

Every sales contract concluded between the Seller and Consumers under these Conditions shall be governed and interpreted in accordance with Italian laws, and in particular by the Consumer Code, with specific reference to regulations on distance contracts and Legislative Decree no. 70 of April 9, 2003, on certain aspects concerning electronic commerce. In any case, the rights possibly granted to Consumers by mandatory legal provisions in force in their respective States shall remain unaffected. In all other cases, the parties declare the Court of Naples to be competent.
